Welcome to Cellar, developed by Shankar Dutt. By downloading, installing, or using our application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using Cellar, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the application.
2. Description of Service
Cellar is a mobile application designed to help users manage their wine and spirits collections. The app provides features for tracking bottles, recording tasting notes, monitoring drinking windows, scanning wine labels, food pairing suggestions, and more.
3. Age Requirement
You must be at least 17 years of age to use Cellar. By using the app, you represent and warrant that you meet this age requirement. The app is intended for personal use in managing alcoholic beverage collections and does not promote underage drinking.
4. Free Trial and Subscriptions
Cellar offers a 7-day free trial of Premium features for new users. After the trial period, you may subscribe to continue using Premium features:
- Free Trial: 7 days of full access to all Premium features, no payment required
- Monthly Subscription: $4.99/month, billed monthly
- Yearly Subscription: $29.99/year, billed annually (best value)
- Lifetime Purchase: $79.99 one-time payment for permanent access
Payment is processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings.
5. User Accounts
Cellar does not require account creation. Your data is stored locally on your device and optionally synced via your personal iCloud account. You are responsible for maintaining the security of your device and iCloud account.
6. Acceptable Use
You agree to use Cellar only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the app for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the app
- Remove or alter any proprietary notices
- Use the app to transmit malware or harmful code
- Interfere with the proper functioning of the app
7. Intellectual Property
Cellar and its contents, features, and functionality are owned by Shankar Dutt and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.
8. User Content
You retain ownership of any content you create in Cellar, including tasting notes, photos, and collection data. By using the app, you grant us a limited license to process and store your content solely for the purpose of providing the service to you.
9. Disclaimer of Warranties
Cellar is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:
- The app will be error-free or uninterrupted
- Defects will be corrected
- The app is free of viruses or harmful components
- Information about wines, drinking windows, or food pairings is accurate
- Label scanning will correctly identify all wines
10. Limitation of Liability
To the maximum extent permitted by law, Shankar Dutt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Cellar. Our total liability shall not exceed the amount you paid for the Premium subscription in the past 12 months.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of Cellar or violation of these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the app or by updating this page. Your continued use of Cellar after changes constitutes acceptance of the new Terms.
13. Termination
We may terminate or suspend your access to Cellar at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
